1. The Experience is promoted and may be booked through the Website or by telephone through the Grand Tour Concierge. An interested Participant will be provided with a presentation of the Grand Tour and the Experience and may contact the dedicated Grand Tour Concierge directly. The Grand Tour Concierge manages the enquiry and booking relationship. A telephone enquiry or request submitted through either of the Website, including preferred dates or other comments, does not constitute a booking, guarantee availability or create a contract. The Organiser may request further information, hold or decline a request, and is not required to accept any enquiry.
2. The Grand Tour Concierge may issue a Proposal setting out the selected Experience, availability, inclusions, payment schedule and cancellation terms. Once the Participant confirms the Proposal, the Grand Tour Concierge will send a Payment Link for the Experience only and will arrange for any associated stay to be confirmed in the reservation system of the relevant Anantara hotel. A booking is formed only when the Participant has accepted the Proposal, supplied the information and documents requested, paid the required amount by the due date and received a Booking Confirmation from the Organiser. A booking is personal to the Participant named in the Booking Confirmation, is not transferable or assignable to any third party, and no substitution of a Participant is permitted unless the Organiser agrees in writing. The required amount is the 70% deposit due upon confirmation, with the remaining 30% due 14 days before the start of the Experience. These Conditions, the Proposal, supplied information and Booking Confirmation and any specific terms expressly stated in it constitute the agreement. If they conflict, the specific terms in the Booking Confirmation prevail, subject always to mandatory rights under applicable law.
3. The applicable price for the Experience is set out in the Proposal and Booking Confirmation. The Experience price covers only the items expressly identified there and is limited to the premium car rental and the applicable vehicle insurance, and full concierge assistance. Guided driving options are available only upon request, subject to availability, and only if expressly confirmed. Any accommodation or other hotel service, connecting flight, meal, transfer, fuel, toll, parking, tax or charge imposed by a third party, optional activity and personal expense is excluded unless expressly confirmed in the Booking Confirmation. A deposit of 70% of the total Experience price is payable upon confirmation and is non-refundable except as expressly provided in the cancellation terms below. The remaining 30% is due 14 days before the start of the Experience. All payments for the Experience are made to and received by Anantara through the Payment Link. The Organiser may cancel a booking and apply the applicable cancellation charges if payment is late or incomplete.
4. The Participant may book the Experience, subject to availability. The Experience is limited to the premium car experience, car rental and applicable vehicle insurance, full concierge assistance, and any guided driving option only if requested, available and expressly confirmed. Any accommodation, additional destination, connecting flight, transfer, meal, activity, event, restaurant or other service is included only if expressly identified in the Booking Confirmation, and no particular vehicle, guide or other service is guaranteed unless expressly so identified.
5. Routes and itineraries shown on the Website or in marketing materials are indicative as to timing and operational details. The Organiser or a Provider may adjust timing, the order of driving segments, the vehicle or the Provider, or make a necessary route adjustment, for weather, traffic, road or venue closures, safety, legal or regulatory requirements, availability, maintenance, operational reasons or other circumstances affecting delivery. The Organiser will communicate material changes as soon as reasonably practicable, but is not responsible for minor or necessary changes or for delay, interruption or additional cost arising from circumstances outside its reasonable control.
6. Each Participant is responsible for providing accurate information and for obtaining and carrying all passports, visas, permits, driving licences, medical documents and other documents required for the Experience and for entry into each country visited. Each driver must hold a valid full driving licence recognised in the relevant country and meet the minimum age, experience and other requirements notified by the Organiser or the Provider; learner or provisional licences are not accepted. The Organiser may refuse participation where a Participant or driver does not meet these requirements or fails to provide requested evidence.
7. Vehicle allocation is subject to availability and the applicable Provider terms. Participants and drivers must comply with all road traffic laws, safety instructions and vehicle-use restrictions, must not drive under the influence of alcohol, or drugs or medication that may affect driving ability, and must not race, test, misuse, modify or take a vehicle off-road unless expressly authorised. The Organiser or the Provider may refuse to hand over a vehicle where it has reasonable grounds to believe that a Participant is under the influence of alcohol, drugs or medication that may affect driving ability. If the Organiser or the Provider has reasonable grounds to believe during the Experience that a Participant is under that influence, it may require the Participant to stop using the vehicle immediately and may withdraw or deny any further use of the vehicle. Participants are responsible for fines, tolls, fuel, cleaning, damage, insurance excesses, security deposits and other charges attributable to their use of a vehicle. A vehicle may be replaced with another vehicle of a reasonably comparable type if necessary for safety, availability or operational reasons.
8. Participants must follow the reasonable instructions of the Organiser, the Grand Tour Concierge, tour leader, guide, mechanic, hotel and each Provider; comply with applicable laws and Provider rules; and behave safely and respectfully towards other guests, staff and members of the public. The Organiser may suspend or end a Participant’s involvement, or deny access to any part of the Experience, where it reasonably considers this necessary for safety, security, proper operation, protection of property or the enjoyment of others, including in the event of misconduct, intoxication, non-compliance or a material risk of damage. The Participant is responsible for any resulting costs and for unused services to the extent attributable to the Participant.
Cancellation requests and requests to change the date of an Experience must be made in writing using the contact details in the Booking Confirmation. The Participant may make one change of date, requested no later than 30 days before the scheduled arrival/start date, subject to availability and any applicable adjustment to the price; any further change or any change requested less than 30 days before that date will be treated as a cancellation and rebooking. Cancellation charges are calculated on the total price of the Experience as follows: more than 60 days before arrival, a full refund of amounts paid less EUR 250 for administrative costs; between 60 and 31 days before arrival, retention of 30% of the total price; between 30 and 15 days before arrival, retention of 70%; 14 days or less before arrival, a 100% penalty; and no-show, a 100% penalty. The applicable percentage of the total price will be retained and any balance paid in excess of that amount will be refunded.
9. The Organiser may cancel, postpone or make a material change to an Experience, route, date, venue, Provider or service where reasonably necessary for safety, legal or regulatory reasons, insufficient availability or participation, supplier failure, maintenance, operational requirements, an event affecting the route or a Force Majeure Event. A “Force Majeure Event” includes fire, flood, extreme weather, natural disaster, epidemic or pandemic, war, terrorism, civil unrest, strike, industrial action, government order, road closure, transport disruption, accident, equipment failure or any other event beyond the Organiser’s reasonable control and, in relation to a Participant’s ability to travel, a documented serious illness, death of an immediate family member or government travel restriction. If the Organiser makes a material change or cancels before departure, it will notify the Participant and, subject always to any mandatory rights or remedies under applicable law, may offer an alternative date or service and will provide any refund or price adjustment required by applicable law or expressly stated in the Booking Confirmation. Where a Participant cannot travel because of a documented Force Majeure Event, Organiser may, in its reasonable discretion, offer a credit valid for 12 months from the date of issue in lieu of a cash refund. This credit option does not exclude or limit any mandatory rights or remedies of a Traveller or consumer under applicable Spanish or European Union law. To the extent permitted by law, the Organiser is not liable for indirect loss, delay or additional expense resulting from such cancellation or change.
10. The Experience may be delivered with the assistance of Providers, including the relevant Anantara properties, BeFast Experience, Alfa Romeo and any vehicle, insurance, guiding or other supplier expressly identified in the Booking Confirmation. The services of a Provider may be subject to its own booking, safety, vehicle, hotel or transport terms, which the Participant must comply with. The Organiser may use, replace or subcontract Providers and may coordinate the services without being the operator or agent of each Provider. Participants must promptly report any issue to the Grand Tour Concierge so that the Organiser can seek to address it.
11. The Experience includes car rental and the applicable vehicle insurance for that rental as described in the Proposal and Booking Confirmation, subject to the Provider’s terms, limits, exclusions and any applicable excess. The Organiser and Anantara do not provide personal travel insurance. Each Participant should arrange and maintain insurance appropriate to the Experience, including travel cancellation, medical and repatriation, personal accident and third-party liability cover, and any vehicle cover not included in the Experience. Participants acknowledge that the Experience may involve driving on public roads, changing weather and other inherent driving and travel risks, and are responsible for assessing their fitness, obtaining medical advice where appropriate, following safety instructions and informing the Organiser of relevant requirements before departure.
12. To the fullest extent permitted by law, the Organiser is not liable for indirect, consequential, special or economic loss, including loss of profit, revenue, business, anticipated savings, opportunity, goodwill, reputation or data. The Organiser is also not responsible for loss, theft of or damage to a person, vehicle, luggage or other property, or for delay, disruption or failure of a service, to the extent caused by a Participant, a third party not engaged by the Organiser, a Provider, road or weather conditions, traffic, public authority action or another circumstance outside the Organiser’s reasonable control, except as provided in clause 14.
13. Nothing in these Conditions excludes or limits liability for death or personal injury caused by the Organiser’s negligence, fraud or fraudulent misrepresentation, wilful misconduct, or any other liability that cannot lawfully be excluded or limited. Subject to the first sentence of this clause and the mandatory rights preserved in these Conditions, the Organiser’s total aggregate liability for direct loss arising out of or in connection with an Experience will not exceed the amount paid to the Organiser for the affected Experience. The Organiser is not liable for loss or damage covered, or required to be covered, by the Participant’s insurance or a Provider’s insurance, except to the extent the Organiser is legally responsible for it.
14. The Participant shall indemnify and keep indemnified the Organiser, its affiliates, officers, employees, agents and Providers against claims, losses, liabilities, damages, costs and reasonable legal expenses arising from or connected with the Participant’s breach of these Conditions, negligence, unlawful act, misuse of a vehicle, or act or omission causing injury, death or damage to any person or property, including acts or omissions of any person in the Participant’s party. This indemnity does not apply to the extent a claim is caused by the Organiser’s own breach, negligence or wilful misconduct.
15. Unless a Provider expressly accepts custody, Participants remain responsible for their luggage, valuables, documents, vehicles and other personal property throughout the Experience. The Organiser does not provide storage, security or care, custody or control of those items and is not responsible for property left unattended or in a vehicle. The Organiser will not be responsible for loss, theft or damage to such property except to the extent liability cannot lawfully be excluded.
16. The Organiser will process personal data in accordance with the privacy notice made available through the Website. Data may be shared with Providers and other entities involved in arranging or delivering the Experience, including the relevant Anantara property, the Grand Tour Concierge, BeFast Experience and Alfa Romeo where applicable. A Participant who provides personal data relating to another person confirms that the person has been informed and that the Participant is authorised to provide it. Marketing communications will be sent in accordance with applicable preferences and law.
17. The Organiser may update these Conditions for future enquiries and bookings to reflect changes in law, regulation, safety requirements, Providers or the operation of the Experience. The version made available through the Website or by the Grand Tour Concierge applies to future enquiries and bookings. After a Booking Confirmation, the Organiser may make changes only where reasonably necessary to operate the Experience and will notify the Participant where appropriate. Any specific terms in a Booking Confirmation remain applicable unless the Participant agrees otherwise or a change is required for legal, safety or operational reasons, and nothing in this clause limits mandatory rights under applicable law.
18. These Conditions and the agreement between the Organiser and the Participant are governed by the laws of Spain, excluding its conflict-of-laws rules. The courts of Spain shall have jurisdiction over disputes, subject to any jurisdiction that cannot lawfully be excluded. Nothing in these Conditions excludes or limits any mandatory rights or remedies that may apply to a Traveller or consumer under applicable law.
